Non-Custodial Income & Assets
Investigation of the paying parent's income is first on our to-do list. It is the major factor in determining support payments. A parent's assets, such as income from work, investments, and property are reviewed. Other factors used to determine support amounts include child health care, extraordinary medical expenses, and the amount of overnight visits the child has with the non-custodial parent.
State Guidelines for Child Support
Maryland State guidelines determine child support. The figures we arrive at from parental income assessment are used in the guideline's formula. The amount of child support calculated by our office is generally the amount ordered by the court because our attorneys use the same child support calculation program that the court uses. There are situations where the amount may be more or less than the amount calculated. Parents may have agreed upon an amount in the divorce settlement or a prenuptial agreement.
Child Support Modification
A parent is entitled to a modification if their support order is more than two years old, or a substantial change in circumstances has occurred since the support order was entered. An increase or decrease in a parent's income or the expenses for the child constitutes a change of circumstances.
